12/22/2023 0 Comments Oversight processGrievance Process (a) Either party, with the agreement of the other party, may submit a grievance to Grievance Mediation at any time within ten (10) working days after the Employer’s decision has been rendered at the step prior to arbitration. Managers with employees on a cross training, rotational, or other temporary assignment should contact appropriate managers to solicit input, as applicable. It is recognized that any practicable process of retention indexing cannot be completely free of error as to method used or as to resulting retention ratings, taking into account: the large numbers of employees, job classifications and SMCs, organizations and requirements involved the fact that numerous management representatives necessarily must participate in the process and that many of the factors which must be dealt with are intangible in nature. Such instructions will stress that retention indexing is to be accomplished without regard to potential adjustments for Company service as provided for in 8.4(f). The Company will instruct and periodically will reinstruct members of management participating in the process to assign retention ratings with the greatest possible care and objectivity, giving full consideration to the objectives stated in 8.2 and 8.4. Review Process The Company will determine the retention rating of each employee, the members of management who will participate in retention index reviews, the retention index groups to be used, the timing, and the other mechanics and details of such reviews. If the employee and the Union are dissatisfied with the answer, they may request a Special Conference. Complaints shall be answered as soon as reasonably possible, but in no event shall an answer be delayed more than five (5) calendar days, unless the time for an answer is extended by mutual agreement. The employee may have the assistance of the Local President in presenting the complaint. The employee may submit the complaint in writing. Notification will be given to a probationary or trial service employee whose work performance is determined to be unsatisfactory.Ĭomplaint Procedures The complaint reporting procedure for allegations of misconduct by participating LEA personnel, including activities undertaken under the authority of this MOA, is included in Appendix B.Ĭomplaint Procedure If an employee has a complaint which is not a proper subject for a grievance under the grievance procedure, the employee may discuss it with his/her immediate supervisor. Employee work performance will be evaluated during probationary, trial service and transition review periods and at least annually thereafter. The employee will receive copies of his or her performance expectations as well as notification of any modifications made during the review period. The immediate supervisor will meet with an employee at the start of his or her review period to discuss performance expectations. Effective Date and TermĮvaluation Process A. The Citizens Oversight Committee shall adopt bylaws that shall govern its operation. Meetings of the Citizens Oversight Committee shall be conducted as public meetings, and provide opportunities for public participation. These annual reports shall additionally be distributed to all parties to this Amended and Restated Agreement. At least sixty (60) days prior to the annual meeting of the Citizens Oversight Committee, the Staff Working Group and the SSPCC shall each submit an annual report regarding the status of the implementation and effectiveness of the Agreement. The Citizens Oversight Committee shall appoint a chairperson, meet at least annually, and report to participating local governments, the School Board and the general public on the effectiveness with which the interlocal agreement is being implemented. Citizens Oversight Committee members shall be invited by the School Board to attend all meetings referenced in Sections 1 and 4 and shall receive copies of all reports and documents produced pursuant to this Amended and Restated Agreement. It shall provide thirty (30)no less than seven (7) days written notice of any meeting to the members of the Citizens Oversight Committee, the Staff Working Group, the SSPCC, County, Cities and to the public. The School Board shall organize and staff the meetings of this Citizens Oversight Committee, calling on the Staff Working Group for assistance as needed. Oversight Process. 110.1 The School Board shall appoint up to nine (9) citizen members, the County and the Miami- Dade County League of Cities shall each appoint up to five (5) citizen members to serve on a committee to monitor implementation of this Amended and Restatede interlocal aAgreement.
